Wonderland Cloud Terms of Service

1. Acceptance of Terms

By accessing or using the Wonderland Cloud services ("Services"), operated by Create Worlds (DBA of Robot Invader, Inc.), a Delaware C corporation ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Services.

2. Description of Service

Wonderland Cloud provides infrastructure for hosting interactive web experiences, including:

  • Pages Hosting: Static and dynamic content hosting for web-based applications, 3D experiences, and related assets.
  • Multiplayer Servers: Custom server hosting enabling real-time communication and data transfer via WebRTC, supported by Google Kubernetes Engine on Google Cloud Platform.

3. User Obligations

You agree to use the Services for lawful purposes only and in compliance with all applicable federal, state, and local laws and regulations. You are solely responsible for ensuring that your use of the Services does not violate any applicable law or the rights of any third party.

4. User Content & Developer Responsibility

"User Content" means all data, code, applications, media, assets, text, images, audio, video, 3D models, and any other material that you or your end users upload, publish, transmit, or otherwise make available through the Services, including content hosted via Pages and content transmitted or processed through Multiplayer servers.

4.1 Sole Responsibility for Content

You are solely and exclusively responsible for all User Content that you host, deploy, distribute, or make accessible through the Services. This includes, without limitation, any content that may be considered adult, explicit, mature-rated, age-restricted, or otherwise sensitive. You acknowledge that you deploy such content entirely at your own risk and discretion.

4.2 No Obligation to Monitor

We do not pre-screen, monitor, review, moderate, or approve User Content. We are under no obligation to inspect or verify any content hosted on or transmitted through the Services. The presence of User Content on our platform does not imply our endorsement, approval, or association with that content.

4.3 Your Representations and Warranties

By using the Services, you represent and warrant that:

  • You have all necessary rights, licenses, and permissions to upload, host, and distribute your User Content.
  • Your User Content does not infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any third party.
  • You comply with all applicable laws regarding the nature, access restrictions, and distribution of your User Content, including but not limited to age-verification requirements, content labeling requirements, and obscenity laws.
  • If your content is age-restricted or adult in nature, you implement appropriate access controls, age-gating mechanisms, and content warnings, and you assume full legal responsibility for compliance with all applicable regulations (including 18 U.S.C. § 2257 record- keeping requirements, if applicable).
  • Your User Content does not contain any material that constitutes child sexual abuse material (CSAM) or exploits minors in any way.

4.4 Right to Remove Content

Notwithstanding our lack of obligation to monitor content, we reserve the right — but not the obligation — to review, refuse, remove, disable access to, or delete any User Content at our sole discretion, at any time, and without prior notice or liability. This includes content that we determine, in our sole judgment, violates these Terms, is objectionable, or poses a risk to the Company, the Services, our users, or any third party.

4.5 No Liability for User Content

We expressly disclaim any and all liability in connection with User Content. Under no circumstances shall we be liable for any User Content, including but not limited to any errors, omissions, or illegality in User Content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any User Content hosted on or transmitted through the Services.

5. Payment Terms

Services are billed through Stripe. You agree to provide accurate and up-to-date payment information and to pay all charges incurred by your account.

6. Data Use and Privacy

Your use of the Services is subject to our Privacy Policy, which governs our collection, use, and disclosure of your personal information.

7. Intellectual Property Rights

You retain all rights to your User Content transmitted through the Services. By using the Services, you grant us a limited, non-exclusive, royalty-free license to use, reproduce, and adapt your User Content solely as necessary to provide and operate the Services. This license terminates when you remove your content or close your account.

8. Indemnification

You agree to indemnify, defend, and hold harmless Create Worlds (DBA of Robot Invader, Inc.), its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your User Content, including any content hosted via Pages or transmitted through Multiplayer servers.
  • Your use or misuse of the Services.
  • Your violation of these Terms.
  • Your violation of any applicable law, regulation, or third-party right.
  • Any claim by a third party related to your User Content, including but not limited to claims of intellectual property infringement, defamation, invasion of privacy, or harm resulting from adult or explicit content you host.

This indemnification obligation survives the termination of these Terms and your use of the Services.

9. Service Modifications and Downtime

We reserve the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. We are not liable for any modification, suspension, or discontinuance of the Services.

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services ceases immediately, and we may delete your User Content without further obligation to you.

You may delete your account at any time through the account deletion feature in the Services. Account deletion permanently removes your personal information, servers, pages, projects, API configurations, custom domains, and team memberships. Active subscriptions are cancelled upon deletion. Certain data may be retained as required by law (e.g., payment records required for tax compliance). Account deletion is irreversible.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATE WORLDS (DBA OF ROBOT INVADER, INC.), ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR ANY USER CONTENT HOSTED ON OR TRANSMITTED THROUGH THE SERVICES.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

14. General Conditions

Your use of the Wonderland Cloud services is at your sole risk. Technical support is only provided to paying account holders and is available via email. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15. Changes to Terms

We reserve the right to update and change these Terms from time to time. When we make material changes, we will update the "Last Updated" date above. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.
